Tripartite Commission for Social and Economic Affairs

The Tripartite Commission for Social and Economic Affairs constitutes a forum of social dialogue held in order to conciliate the interests of employees, the interests of employers and public welfare. The Commission main objective is to achieve and maintain social peace.

Tasks and competences of the Tripartite Commission are set out by the Act of 6 July 2001 on the Tripartite Commission for Social and Economic Affairs and voivodship social dialogue commissions (Official Journal from 2001 no 100, item 1080, as amended)

The Act on the Tripartite Commission for Social and Economic Affairs and voivodship social dialogue commissions provides that:
1. Commission meetings shall be held if need be, but at least once every two moths.
2. The Commission shall be responsible for holding social dialogue on remuneration, social benefits and other social or economic matters, as well as for executing tasks specified in separate legal acts.
3. Each party of the Commission shall have the right to put on the agenda issues of great social or economic importance, if it deems such issues significant in view of social peace.


The Commission is composed of representatives of the Government, employees and employers.
The Government is represented by members of the Council of Ministers appointed by the Prime Minister, their number depending on the Prime Minister’s decision.
Employees are represented by representative trade union organisations.
Employers’ voice is expressed by representative employers’ organisations.

The proceedings of the Commission are chaired by the Presidium, e.g. Commission chairperson and vice-chairpeople.
The position of the chairperson is held by the Minister of Economy and Labour. Each of the representative member organizations select one vice-chairperson.
The Presidium decides on the Commission action programme and works schedule as well as the agenda of its meetings. It also examines the matters submitted by the Commission.
Commission meetings are summoned by the chairperson.

Problem team for economic policy and labour market

The team deals with the issues of labour market and economic policy. It provides consultation on proposals and drafts of legal acts, government programmes and other documents related to Poland’s economic policy and labour market and works out, if needed, its own proposals. The team also conducts analysis and evaluation of actions in the areas of economic and labour market policy. It is entitled to assess the state of national preparation to use the European support funds, both before and after the accession.

The team deals with the issues of labour law and collective agreements. It evaluates how provisions of law are applied in terms of their social and economic impact and examines the activity of control authorities in the areas of labour law and employment legality. It is entitled to take position on notified drafts of legal acts, government programmes and other documents regarding labour law and collective agreements. It may also draw up its own proposals concerning changes of regulations in the area of labour law.

The team deals with the issues of social dialogue. It develops proposals of and provides consultation on drafts of legal acts, government programmes and other relevant documents. The team analyses and evaluates how institutions of social dialogue function and how this dialogue proceeds on the national, provincial and sectoral level. It also examines legal provisions and practical solutions adopted within the frameworks of the social dialogue in other countries and on the forum of the European Union institutions. The team cooperates with the parties of the twinning agreement under the PHARE 2000 “Social Dialogue” programme whose aim is to strengthen the mechanisms of the social dialogue and prepare social partners to participate actively in this dialogue.

The team deals with the issues of social insurance. It provides consultation on proposals and drafts of legal acts, government programmes and other relevant documents. It analyses and evaluates how the social insurance system works and to what extent the objectives of the social insurance reform are achieved. The team initiates and evaluates the process of adjustment of the social insurance system to demographic and economic changes; it cooperates with social insurance institutions and compares Polish solutions in the area of social insurance system with experiences of other countries.

The tasks of the team, established by the Commission decision from 9 September 2002, include development of the parties’ common positions and opinions on matters concerning the public services sector. It issues opinions on drafts of legal acts, government programmes and other documents related to the public services sector, in particular those concerning health service, education, culture, social assistance and care. The team also carries out analyses and assessments of the whole public services system or a selected part of it in terms of its way of functioning and financial policy. It cooperates with the team for budget, remuneration and social benefits, the team for economic policy and labour market, and the voivodship social dialogue commissions.

The team deals with matters related to the state budget, remuneration and social benefits. Therefore, its tasks include consultation on proposals and drafts of legal acts, government programmes and other related documents, including those concerning the state budget and proposed indicators of remuneration increase in the private and public sectors. The team also examines other countries’ experiences in defining such categories and criteria as: social minimum, existence minimum and guaranteed income. It assesses the situation of the state budget, including the amount and structure of social expenditure, analyses and evaluates the social security system.

Problem team for cooperation with the International Labour Organization

The team is a consultative and advisory body in matters related to the cooperation with the International Labour Organization. Its provides joint consultations on issues placed on the agenda of the International Labour Conference, discusses the composition of delegations for successive sessions of the Conference and expresses opinions on matters of common interest in the context of Polish participation in those sessions. The team also issues opinions on draft conventions and recommendations prepared by the International Labour Conference, proposals of requests to be submitted to particular authorities in view of the forthcoming conventions and recommendations, pursuant to Article 19 of the Constitution of the International Labour Organization, and draft reports presented by the Council of Ministers to the International Labour Office, pursuant to Article 22 of the ILO Constitution. The team is entitled to propose, on its own initiative, to examine unratified conventions and recommendations which have not been put into effect yet and to initiate other agreed measures to develop trilateral relations between Poland and the International Labour Organization, including opinions on proposals concerning multiannual cooperation development programmes between Poland and the International Labour Office and its institutions.

Problem team for structural funds of the European Union

The team was formed by the Commission decision no. 25 from 6 July 2004. Its tasks include:
• support for the process of Poland’s preparation to make use of the EU structural funds,
• evaluation of draft programme documents,
• evaluation of the use of structural funds,
• presentation of opinions and positions on functioning of particular operating programmes to programme managing institutions,
• examination of other countries’ experiences as regards the use of the EU structural funds.

Problem team for the Revised European Social Chart

On 14 September 2005 the problem team for the Revised European Social Chart was established, its tasks including:
1. Establishing the proposed extent of the planned ratification of the Revised European Social Chart.
2. Analysis of compatibility of the Polish legislation with the provisions of Revised European Social Chart, particularly in terms of its social and economic impact.
3. Analysis and development of a position on adoption of the Additional Protocol to the Revised European Social Chart establishing the Collective Claims System.
4. Review and evaluation of compliance with of the obligations resulting from the Revised European Social Chart.
5. Monitoring of the obligations undertaken.
